Accredited by the Belgian Federal Mediation Commission in civil and commercial matters, with a further specialisation in family mediation.
Expert work and mediation are two different trades. The expert examines and concludes. The mediator concludes nothing: he brings the parties to a solution they reach themselves. I never perform both roles in the same dispute.
When mediation is worth considering
When the relationship must survive
Between business partners, within a family, between a supplier and a long-standing customer: a judgment resolves the dispute and frequently ends the relationship as well. Mediation allows both to be preserved.
When time matters
Litigation runs for years. A mediation is usually concluded in a handful of sessions, and the resulting agreement can be submitted to a Belgian court for approval, giving it the force of a judgment.
When discretion matters
Mediation is confidential by statute in Belgium. What is said cannot afterwards be relied on in proceedings. For companies and for families that is often the deciding factor.
When the subject is technical
In disputes about materials, workmanship or value, it helps that the mediator understands the subject — without having to rule on it.
How it runs
A first conversation, without charge, establishes whether the matter is suitable. If it is, a mediation protocol is signed setting out the framework, the confidentiality undertaking and the costs. Sessions follow, jointly or separately. Any agreement is recorded in writing and, if the parties wish, submitted for judicial approval.
